Trademark and Brand Use Guidelines

Acadia Marketing LLC

1. Purpose and Scope

These Trademark and Brand Use Guidelines explain how names, logos and other brand identifiers associated with Acadia Marketing LLC, a Maine limited liability company, may and may not be used. They apply to everyone who visits or uses acadiamarketingmaine.com and any page, subdomain or transfer page that Acadia Marketing LLC operates or issues to clients (the "Sites"), and to anyone who refers to our services in any medium.

These Guidelines supplement, and do not replace, our Terms of Use, Intellectual Property and Copyright, Acceptable Use Policy, and Disclaimers and Limitation of Liability. If a written agreement with us addresses brand use, that agreement controls to the extent it differs from these Guidelines.

2. Our Marks

The name "Acadia Marketing LLC", our other names, logos, slogans, graphics, page layouts and distinctive visual styles used in connection with our services (together, "our Marks") are owned by or licensed to Acadia Marketing LLC. Our Marks are protected under applicable trademark, unfair competition and other laws.

Nothing on the Sites or in any agreement grants you a license or right to use our Marks except as expressly stated in these Guidelines or in a written agreement with us. All goodwill arising from any permitted use belongs to Acadia Marketing LLC.

3. Permitted References

You may refer to Acadia Marketing LLC by its name in a truthful, factual manner, provided that the reference is in plain text and does not suggest any relationship we have not agreed to. Examples of permitted references include:

  • stating accurately that you are or were a client of Acadia Marketing LLC;
  • identifying us as the provider of website design and development, website hosting, domain name management, email setup, search and advertising management, SMS and text-message lead alerts, or website and domain transfer services;
  • linking to the Sites without altering the appearance of our Marks;
  • quoting or citing public information from the Sites with proper attribution; and
  • making news, review or educational commentary that is accurate and not misleading.

Use of our logos, stylized marks or artwork requires our prior written permission, except where we have supplied them to you for a stated purpose. Any permitted use must follow the form, proportions and colors we provide, and may be used only for the stated purpose.

4. No Implied Endorsement

You may not use our Marks, or any confusingly similar name, logo, domain name or social media identifier, in a way that states or implies that Acadia Marketing LLC sponsors, endorses, certifies, approves or is affiliated with you, your business, your products or your statements, unless we have agreed in writing.

You may not:

  • register or use a business name, domain name, account name or hashtag that incorporates or closely resembles our Marks;
  • present our work, reports or communications in a manner that alters their meaning or suggests an approval we have not given;
  • use our Marks in advertising keywords, metadata or page titles in a way that diverts people seeking our services; or
  • use our Marks in connection with content that is unlawful, deceptive or disparaging, or that violates our Acceptable Use Policy.

5. Client Marks Used Only as Authorized

In providing our services we may handle names, logos and other marks that belong to our clients or to third parties. We use those marks only as authorized by the owner, only as needed to perform the applicable agreement, and only in the manner the owner permits.

Clients are responsible for confirming that they hold the rights to any marks, images, text or other materials they provide to us. Providing materials to us does not transfer ownership of them, and we acquire no rights in a client's marks beyond the limited permission needed to deliver the services. Where a website or domain is transferred under our Website and Domain Transfer Terms, client marks remain the property of the client, and our Marks remain ours. Hosting that continues under the existing agreements does not change the ownership of any marks.

We do not use a client's marks in our own promotional materials unless the client has authorized that use.

6. Third-Party Marks

Other names and logos that appear in connection with the Sites or our services may be marks of their respective owners. Their appearance does not indicate any affiliation, sponsorship or endorsement, and we make no claim to them.

7. Reporting Misuse

If you believe that someone is using our Marks without permission, or is presenting a false affiliation with Acadia Marketing LLC, please notify us in writing. Please include the following information so that we can review the matter:

  • a description of the use and where it appears, including any web address;
  • screenshots or other copies, where available;
  • how you became aware of the use; and
  • your name and a means of contacting you.

Send reports to info@acadiamarketingmaine.com, or write to Acadia Marketing LLC, 218 Pond Road, Wilton, ME 04294. You may also call (207) 716-9079. Notices are handled in accordance with our Electronic Communications and Notices document. We review reports in good faith, but we are not obligated to take any particular action, and we may act without notice to the person responsible.

8. Enforcement

We may take any step available to us to protect our Marks, including requesting removal of content, contacting hosting providers, registrars or platform operators, suspending access to the Sites or services under the applicable agreement, and pursuing remedies allowed by law. Our decision not to act in one instance does not waive our rights in any other.

9. Changes to These Guidelines

We may revise these Guidelines from time to time by posting an updated version on the Sites. Continued use of our Marks or the Sites after an update is posted means that you accept the revised Guidelines.

10. Governing Law

These Guidelines are governed by the laws of the State of Maine, without regard to conflict of law principles. Disputes are resolved as described in our Governing Law and Dispute Resolution document, with venue in Cumberland County, Maine.
