Text Messaging and Lead Alert Policy

Acadia Marketing LLC

1. Purpose and Scope

This Text Messaging and Lead Alert Policy describes how Acadia Marketing LLC, a Maine limited liability company ("Acadia Marketing LLC", "we", "us"), uses SMS and text messages in connection with our SMS and text-message lead alert service. It applies to the Sites, which means acadiamarketingmaine.com and any page, subdomain or transfer page we operate or issue to clients, and to every person who requests, receives or is a designated recipient of messages from us.

This policy should be read together with our Terms of Use, Privacy Policy, Acceptable Use Policy, and Electronic Communications and Notices. If this policy conflicts with the applicable agreement for a particular service, the applicable agreement controls for that service.

2. What Lead Alerts Are

A lead alert is a text message that notifies a client, or a designated recipient the client has named, that a visitor has submitted an inquiry, form, call request or similar contact through a website or tool we manage. A lead alert typically summarizes the inquiry so that the recipient can follow up.

Lead alerts are transactional and service-related. They are sent to support the services described in the applicable agreement and are not advertisements.

We send lead alerts only to mobile numbers for which we have obtained consent. Consent is given when a client or an authorized representative provides a mobile number during onboarding or in a service setup form and agrees to receive lead alerts at that number, or when a designated recipient otherwise confirms that they wish to receive them.

By providing a mobile number for lead alerts, the person providing it represents that:

  • they are the subscriber or customary user of the number, or are authorized by that person to give consent;
  • the information they provide is accurate and current; and
  • they understand that consent is not a condition of purchasing any service from us beyond the lead alert service itself.

We keep records of consent as required by applicable rules and may ask a designated recipient to reconfirm consent from time to time.

4. Message Frequency

Message frequency varies. Lead alerts are sent when an inquiry is received, so the number of messages depends on how many inquiries a client's website or tools generate. Some designated recipients may receive several messages in a short period and others may receive none for an extended time. We may also send occasional service messages, such as confirmation of enrollment, confirmation of an opt-out, or notice of a change to the service.

5. Carrier Charges

We do not charge a separate fee for receiving lead alerts under this policy, except as stated in the applicable agreement. Message and data rates from the recipient's mobile carrier may apply, depending on the recipient's plan. Carriers are not liable for delayed or undelivered messages, and we are not responsible for charges imposed by a carrier.

6. Opting Out

A recipient may stop receiving messages at any time by replying STOP to any message we send. We may also honor other clear opt-out words and phrases, such as CANCEL, END, QUIT or UNSUBSCRIBE. After an opt-out, we will send a confirmation message and will not send further lead alerts to that number unless the recipient later opts back in.

A recipient who needs assistance may reply HELP or contact us using the details in Section 12. A client may also ask us to add, change or remove a designated recipient's number by written notice to the email address in Section 12. Opting out of text messages does not end any other service under the applicable agreement.

7. Registered Sending Numbers

We send messages from sending numbers that are registered for messaging use with the messaging carrier and the messaging platform provider, as required by applicable carrier and industry rules. We do not use unregistered numbers, disguised numbers or deceptive sender information. The sending number may change from time to time for operational reasons, and recipients should not rely on a number remaining the same.

We do not attempt to evade carrier filtering, and we do not permit others to use our sending numbers for that purpose.

We do not send marketing or promotional text messages to any person without that person's prior express consent to receive them. Consent to receive lead alerts is not consent to receive marketing messages. Where we offer marketing messages, we will request consent separately, describe the nature of the messages, and honor opt-outs in the same manner described in this policy.

We do not sell, rent or share mobile numbers or text messaging consent with third parties for their own marketing purposes.

9. Compliance With Applicable Rules

We aim to comply with the laws, regulations, carrier requirements and industry guidelines that apply to text messaging, including rules on consent, identification of the sender, permitted hours, opt-out handling and record keeping. Clients who use our messaging services agree to use them only for lawful purposes, to provide only numbers for which they have authority, and to follow our Acceptable Use Policy.

We may suspend or limit messaging to any number, or to any account, where we reasonably believe it is necessary to comply with applicable rules, to respond to a carrier request, or to prevent misuse.

10. Message Content and Privacy

Lead alerts may include information submitted by a website visitor, such as a name, contact details and the substance of an inquiry. Recipients are responsible for handling that information appropriately. We handle personal information as described in our Privacy Policy, and we apply the measures described in our Access Logging and Security Notice. Text messages are not a secure channel, and we recommend that recipients avoid replying with sensitive information.

11. Delivery and Availability

Text message delivery depends on networks, carriers and devices outside our control. We do not guarantee that any message will be delivered, delivered in a particular time, or delivered without error. Lead alert messaging is provided as a convenience and should not be the only means by which a client monitors inquiries. The Disclaimers and Limitation of Liability document applies to this service.

12. Changes and Contact

We may update this policy from time to time by posting the revised version on the Sites. Continued receipt or use of the messaging service after an update means acceptance of the revised policy to the extent permitted by law. This policy is governed by the laws of the State of Maine, and disputes are handled as described in our Governing Law and Dispute Resolution document, with venue in Cumberland County, Maine.
