Reviews and Testimonials

Acadia Marketing LLC

1. Purpose and Scope

This document explains how Acadia Marketing LLC, a Maine limited liability company ("Acadia Marketing LLC", "we", "us"), handles reviews, testimonials, client names, logos, project results and similar materials. It applies to acadiamarketingmaine.com and to any page, subdomain or transfer page that Acadia Marketing LLC operates or issues to clients (the "Sites"), and to our marketing materials generally. It supplements, and does not replace, the applicable agreement with each client.

We display a client's business name, logo, website, screenshots, project descriptions or results in our portfolio, case summaries or promotional materials only with that client's consent. Consent may be given in the applicable agreement, in a written approval, or by another clear written election that we keep on record.

  • Consent covers only the materials and purposes the client has approved.
  • We do not alter a logo, imply an endorsement the client has not given, or present a client's materials in a misleading context.
  • We do not publish confidential business information, account credentials, customer data, analytics access or non-public financial details.
  • Where a project involves a third party's work or marks, we display it only to the extent we are permitted to do so.

3. Results and Performance Descriptions

When we describe results, we describe work that was actually performed for a client and figures that were actually recorded. Any result we present is an example of a past engagement. It is not a promise, forecast or guarantee that any other client will achieve the same or similar outcomes. Results depend on many factors outside our control, including market conditions, competition, search engine and advertising platform policies, and the client's own business decisions. Where a result is presented with context, such as a time period or source, we keep records sufficient to support it.

4. Testimonials and Reviews We Publish

We publish a testimonial or review of our services only if it was provided by a real client or customer and the person who provided it has agreed to its use. We do not create, purchase, exchange for undisclosed compensation, or fabricate reviews or testimonials. We do not write reviews of our own services under another name, and we do not ask or permit anyone to do so on our behalf.

  • We may shorten a testimonial for length or clarity, but we do not change its meaning.
  • We do not selectively edit a review in a way that reverses or distorts what the author said.
  • If a testimonial was given in exchange for a discount, credit or other benefit, we disclose that fact where the law requires.
  • We attribute a testimonial only as the author has permitted, and we may publish it without a name when the author prefers.

5. Requesting Reviews

We may encourage clients to share their honest experience on a public review platform. We do not require a favorable review, we do not condition services or support on the content of a review, and we do not discourage a client from sharing an honest opinion. Where we help a client set up tools to request reviews from the client's own customers, those requests must comply with the rules of the relevant review platform and with applicable law, and must not be directed only at customers expected to respond favorably.

6. Responding to Public Reviews on a Client's Behalf

We respond to a public review of a client's business only when the client has authorized us to do so. Authorization may be given in the applicable agreement or in a written instruction, and it may be limited to certain platforms, review types or subject matters. When we respond under that authorization:

  • We use only information the client has approved for that purpose.
  • We do not disclose private customer information, and we do not confirm that a reviewer was a customer unless the client has directed it and the law and the platform permit it.
  • We do not post responses that are deceptive, harassing or defamatory, and we do not impersonate a reviewer or a third party.
  • We may decline to post, or may pause responses, if we believe a response would violate platform rules or applicable law.

The client remains responsible for its own business decisions, for the accuracy of the information it gives us, and for its relationship with its customers. Without authorization, we do not reply to, flag, dispute or attempt to remove a client's reviews.

7. Reviews of Our Own Services by Others

Third parties may post reviews of Acadia Marketing LLC on platforms we do not control. We do not guarantee that those reviews are accurate or complete. We may respond publicly or privately, and we may report content to the platform that violates its rules, but we do not offer incentives to remove or change a review.

A client or reviewer may withdraw consent to the use of a name, logo, testimonial, result or other material at any time by sending a written request to info@acadiamarketingmaine.com. Please identify the material and where it appears so that we can locate it.

  • After we receive a request, we will remove the material from the Sites and from materials we control within a reasonable period.
  • Withdrawal does not affect use that occurred before the request was received.
  • We cannot control copies made by third parties, archived pages, or materials already distributed in printed or other fixed form, although we will make reasonable efforts to stop further distribution.
  • Withdrawal of consent for portfolio use does not change the client's other rights and obligations under the applicable agreement.

9. Client Content and Ownership

Clients retain ownership of their own marks, content and materials. Nothing in this document transfers ownership of any logo, name or testimonial to us. Consent under this document gives us a limited permission to display the approved materials for the purposes described, and it is subject to the Intellectual Property and Copyright document and the applicable agreement.

This document should be read together with our Terms of Use, Privacy Policy, Acceptable Use Policy, Intellectual Property and Copyright, Disclaimers and Limitation of Liability, Electronic Communications and Notices, and Governing Law and Dispute Resolution. Hosting and related services after any website or domain transfer continue under the existing agreements.

11. Governing Law and Contact

This document is governed by the laws of the State of Maine, and venue for any dispute lies in Cumberland County, Maine, as further described in Governing Law and Dispute Resolution. Questions, consent changes and removal requests may be sent to info@acadiamarketingmaine.com, by mail to Acadia Marketing LLC, 218 Pond Road, Wilton, ME 04294, or by phone at (207) 716-9079.
