Acadia Marketing LLC

1. Introduction and Scope

This Privacy Policy explains how Acadia Marketing LLC, a Maine limited liability company ("Acadia Marketing LLC," "we," "us"), collects, uses, shares and protects information in connection with acadiamarketingmaine.com and any page, subdomain or transfer page that we operate or issue to clients (collectively, the "Sites"). It also applies to information we receive when we provide website design and development, website hosting, domain name management, email setup, search and advertising management, and client website and domain transfer services. By using the Sites, you acknowledge the practices described here.

2. Information We Collect

We collect the following categories of information:

  • Information you provide. When you submit a contact form, send us an email, call us or send a text message, we receive the details you choose to give us, such as your name, business name, email address, telephone number, website address and the content of your message.
  • Service and account information. To provide our services we may handle domain registration details, DNS settings, hosting configuration, email account settings and similar technical information needed to operate a client's web presence.
  • Access logs. Our servers and transfer pages record the date, time, IP address, browser type and the pages or files requested. Visits to and downloads from transfer pages are logged with this information for security purposes.
  • Cookies and similar technologies. The Sites may use cookies, local storage and similar tools to keep the Sites functioning, remember preferences and understand aggregate usage.
  • Email information. If you correspond with us, we retain the messages and related technical headers, and we may record whether a message was delivered.

3. Transfer Pages

Transfer pages are issued to a named designated recipient and are protected by an access code. They may contain transfer codes (also known as EPP codes) for domain names and website source files. These materials are confidential. Each visit and download is logged to help us detect unauthorized access and to maintain an accurate record of delivery. If you were not the designated recipient, do not use any access code, transfer code or file, and notify us at the address in Section 14.

4. How We Use Information

We use information to respond to inquiries; to provide, operate, maintain and support our services; to deliver domain and website transfers; to communicate with you about services, billing and administrative matters; to secure the Sites and investigate misuse; to measure and improve the Sites; and to comply with legal obligations and enforce our agreements.

Where the law requires a legal basis, we rely on one or more of the following: performance of a contract or steps taken at your request before entering a contract; our legitimate interests in operating, securing and improving our business and services; your consent, where we ask for it; and compliance with legal obligations.

6. Sharing With Service Providers

We do not sell personal information. We share information with third parties only as needed to operate our business, including hosting providers, email delivery and mailbox providers, domain registrars and DNS providers, analytics providers, and text messaging providers. These providers act on our behalf and may process information only for the services they perform for us. We may also disclose information when required by law, to respond to valid legal process, to protect rights, property or safety, or in connection with a merger, financing or sale of all or part of our business.

7. Cookies and Analytics

You can control cookies through your browser settings, including blocking or deleting them. Disabling certain cookies may affect how the Sites work. Analytics tools, where used, provide us with aggregated information about how the Sites are used.

8. Retention

We keep information for as long as needed for the purposes described in this Privacy Policy, including to provide services, resolve disputes, maintain security records and meet legal, tax and accounting requirements. When information is no longer needed, we delete or de-identify it in the ordinary course of business.

9. Security

We use administrative, technical and physical safeguards designed to protect information, including access codes, access controls and activity logging. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please keep any access code or transfer code confidential.

10. Your Choices

You may ask us to access, correct or delete personal information we hold about you, subject to legal and contractual limits. You may opt out of marketing messages by following the instructions in the message or by contacting us, and you may reply STOP to a text message to end texts. We may still send service-related communications. To make a request, contact us as described in Section 14.

11. Children

The Sites are intended for businesses and are not directed to children under 13. We do not knowingly collect personal information from children. If you believe a child has provided information to us, contact us and we will review the request and delete the information where appropriate.

12. Maine and U.S. Residents

We operate from Maine and handle information in the United States. If you access the Sites from elsewhere, you understand that information may be processed in the United States. Residents of Maine and other states may have rights under applicable state law, which we honor to the extent those laws apply to us. This Privacy Policy is governed by the laws of the State of Maine, and any dispute concerning it will be brought in Cumberland County, Maine.

13. Changes to This Policy

We may update this Privacy Policy from time to time. The version posted on the Sites is the version in effect, and continued use of the Sites after an update means you accept the revised Privacy Policy. Hosting of client sites continues under the existing agreements, which this Privacy Policy does not replace.
