Email Services Terms
Acadia Marketing LLC
1. Purpose and Scope
These terms govern email setup and mailbox services provided by Acadia Marketing LLC, a Maine limited liability company ("Acadia Marketing LLC," "we," "us"), to clients in connection with the Sites. They apply whenever we create, configure, connect, or manage a mailbox or email domain configuration on a client's behalf. They supplement the applicable agreement between the client and us and the other published documents identified in Section 11.
2. Mailbox Creation
Upon a client's request and subject to the applicable agreement, we may create one or more mailboxes on a domain the client owns or is authorized to use. Before we create a mailbox, the client confirms that it controls the domain or holds the authority to direct changes to it. We may decline a requested mailbox name that is misleading, impersonates another party, or conflicts with the Acceptable Use Policy. Mailboxes are provided through the hosting provider or another mail service we select, and we may change the underlying provider when we consider it reasonable, with the service continuing under the existing agreements.
3. Credentials
When we create a mailbox we set initial credentials and deliver them to the client by a method we consider reasonably secure. The client is responsible for changing the initial credentials promptly, keeping them confidential, and limiting access to authorized persons. Activity carried out with valid credentials is treated as the client's activity. The client must notify us at once through the address in Section 12 if it suspects that credentials have been lost, shared, or misused. We may reset credentials, require a stronger credential, or require re-verification of identity where we consider it necessary to protect the account. Handling of credentials and authentication events is further described in the Access Code and Authentication Policy and the Access Logging and Security Notice.
4. DNS Authentication Records
To support delivery and reduce spoofing, we may add or modify DNS records for the client's domain, including mail routing records and sender authentication records such as SPF, DKIM, and DMARC. These records are generally necessary for the mailbox to function and for outgoing messages to be accepted by receiving systems. The client agrees that we may make such changes at the registrar or DNS host where the client has given us access. We will not change nameservers, transfer a domain, or delete a domain without the client's separate approval. Where a client or another party edits the same records, the client is responsible for ensuring that the authentication records remain accurate and complete. Delivery depends on receiving systems and third parties, and we do not promise that any message will be delivered, accepted, or placed in any particular folder.
5. Client Responsibility for Content
The client is solely responsible for all messages, attachments, and data sent, received, stored, or forwarded through its mailboxes, and for the lawfulness of its communications. This includes compliance with laws governing commercial email, consent, privacy, and record retention. We do not review mailbox content in the ordinary course and do not undertake to back up, archive, or preserve it unless the applicable agreement says so. The client should maintain its own copies of important messages and records.
6. Storage and Usage Limits
Mailboxes are subject to storage, message size, sending volume, and connection limits set by the hosting provider and described in the applicable agreement. These limits may change from time to time. When a mailbox reaches a limit, messages may be delayed, rejected, or returned to the sender, and the client may be unable to send. The client is responsible for managing its storage by deleting or exporting messages. We may suspend sending that exceeds reasonable usage or that threatens the performance of shared systems.
7. Related Messaging Services
Where we configure email or SMS and text-message lead alerts for a client, those services depend on third-party systems, including the hosting provider and messaging carriers. The client is responsible for supplying accurate addresses and numbers for each designated recipient and for ensuring that each designated recipient has the authority to receive and act on alerts. Carriers may filter, delay, or block messages, and we are not responsible for third-party outages or filtering decisions.
8. Suspension for Abuse
We may suspend, restrict, or disable a mailbox, sending capability, or related DNS records, with or without prior notice, where we reasonably believe that:
- the mailbox is being used for spam, phishing, fraud, malware, or other unlawful or deceptive activity;
- credentials have been compromised or the account is being accessed without authorization;
- use violates the Acceptable Use Policy or the Terms of Use;
- continued operation risks harm to our systems, the hosting provider, other clients, or third parties;
- we receive a legal demand, a complaint from a receiving system, or a requirement from a provider.
We will try to notify the client where practicable and lawful. We may restore service once the cause has been resolved to our satisfaction. Suspension does not relieve the client of amounts owed under the applicable agreement.
9. Migration
If a client asks us to move mailboxes to or from another provider, we will cooperate within the scope of the applicable agreement. Migration may involve changing mail routing and authentication records and may temporarily affect delivery. Not every message, folder, setting, or attachment can be moved in every case, and the client is responsible for verifying the result and keeping its own copies before migration begins. Where a website or domain is transferred under the Website and Domain Transfer Terms, mailbox and hosting arrangements continue under the existing agreements unless the parties agree otherwise in writing.
10. Closure
A mailbox may be closed at the client's written request or on termination or expiration of the applicable agreement, or under Section 8. Upon closure, access ends and we may delete the mailbox and its contents after the retention period, if any, described in the applicable agreement or the Privacy Policy. The client should export anything it needs before closure. We may remove mail routing and authentication records that we added, and the client is responsible for updating any records that should remain. Closure does not affect rights and obligations that arose before it.
11. Relationship to Other Documents
These terms should be read with the Terms of Use, Privacy Policy, Cookie Notice, Website and Domain Transfer Terms, Access Code and Authentication Policy, Access Logging and Security Notice, Acceptable Use Policy, Electronic Communications and Notices, Intellectual Property and Copyright, Disclaimers and Limitation of Liability, Accessibility Statement, and Governing Law and Dispute Resolution. If these terms conflict with the applicable written agreement for a particular client, that agreement controls as to the conflict. These terms are governed by the laws of the State of Maine, with venue in Cumberland County, Maine, as further provided in the Governing Law and Dispute Resolution document.
