Electronic Communications and Notices
Acadia Marketing LLC
1. Purpose and Scope
This document explains how Acadia Marketing LLC, a Maine limited liability company ("Acadia Marketing LLC," "we," "us"), communicates with you electronically and how notices are given between us. It applies to acadiamarketingmaine.com and to any page, subdomain or transfer page that Acadia Marketing LLC operates or issues to clients (collectively, the "Sites"), and to the services we provide through them. Those services include website design and development, website hosting, domain name management, email setup, search and advertising management, and client website and domain transfer services.
2. Consent to Receive Electronic Communications
By using the Sites, submitting a form, requesting a service, opening a transfer page, or entering into an agreement with us, you agree that we may provide notices, disclosures, agreements, statements, invoices, receipts and other communications ("Communications") to you in electronic form. You agree that electronic Communications satisfy any legal requirement that such Communications be in writing, to the fullest extent permitted by applicable law.
You confirm that you are able to access and retain electronic Communications, and that you will keep us informed of any change to your email address or other contact details so that Communications reach you.
3. How We Send Communications
We may deliver Communications by any of the following means:
- email to the address you provided to us or that appears in your account or agreement records;
- posting on a Site, including a transfer page issued to a designated recipient;
- text message to a mobile number you provided, where you have given us that number for service contact; and
- a link in an email or message that directs you to a Site where the Communication can be viewed, printed or downloaded.
A Communication sent by email is treated as delivered when we send it, unless we receive notice that it could not be delivered. A Communication posted on a Site is treated as delivered when it is made available there. You are responsible for checking the email account you gave us, including any spam or junk folder, and for configuring your systems so that messages from info@acadiamarketingmaine.com are not blocked.
4. Transfer Pages and Access Codes
A transfer page is issued to a named designated recipient and is protected by an access code. It may contain domain transfer (EPP) codes and website source files. Visits and downloads are logged with date, time, IP address and browser for security. The designated recipient must not share the access code, any transfer code or any files with anyone the designated recipient has not authorized. We may send the link to a transfer page and related instructions electronically, and may send the access code through a separate electronic channel.
A transfer code moves a domain to another registrar. After a transfer, the domain and its renewals belong to the new registrant. The Sites remain on Acadia Marketing LLC hosting under the existing agreements, and hosting continues under the existing agreements.
If you receive a transfer page, access code or related message that you did not expect, or you are not the designated recipient, do not use the transfer code or the access code. Email info@acadiamarketingmaine.com so that we can address it.
5. Hardware and Software Requirements
To receive and keep electronic Communications you need a device with internet access, a current web browser, a working email account, and software able to open PDF files and common document formats. If our requirements change in a way that creates a material risk that you will be unable to access Communications, we will tell you before the change takes effect.
6. Paper Copies
You may request a paper copy of any Communication that we have provided electronically by writing to us at the address in Section 9. We may charge a reasonable fee for the cost of preparing and mailing paper copies, which we will identify to you when you make the request.
7. Withdrawing Consent
You may withdraw your consent to receive electronic Communications at any time by sending written notice to info@acadiamarketingmaine.com or to our mailing address. Your notice should identify you, the business or agreement concerned and the email address or number to be removed. Withdrawal does not affect the validity of Communications already provided electronically. Because many of our services, including hosting, domain management and transfer services, depend on electronic delivery, withdrawing consent may require us to end or modify the affected service, and we will explain the effect to you when we receive your notice. Withdrawal of consent to marketing messages does not stop service, account and security messages that we need to send you.
8. Record Retention
We keep copies of Communications, agreements, transfer page records and access logs for as long as needed to provide our services, to protect the security of the Sites, to resolve disputes, and to meet legal, tax and accounting obligations. Access logs record the date, time, IP address and browser of visits and downloads. You are responsible for saving or printing any Communication you wish to keep for your own records, because links and transfer pages may be removed once their purpose has been served.
9. Sending Notices to Us
Notices to Acadia Marketing LLC must be in writing and sent by email or by mail to:
- Email: info@acadiamarketingmaine.com
- Mail: Acadia Marketing LLC, 218 Pond Road, Wilton, ME 04294
- Telephone, for general questions only: (207) 716-9079
A telephone call, a message through a social media account or a comment on a Site is not a formal notice. A notice sent by email is effective when we receive it. A notice sent by mail is effective when we receive it at the mailing address above. Please include your name, the business or domain concerned and a clear description of the matter.
10. Security of Communications
Email and text messages are not always secure. We will not ask you by email or text message for your passwords. If you are uncertain whether a message came from us, contact us using the email address or telephone number in Section 9 before acting on it.
11. Changes, Governing Law and Venue
We may update this document from time to time by posting the revised version on a Site. Your continued use of the Sites or our services after posting means you accept the revised version. This document is governed by the laws of the State of Maine, without regard to conflict of law rules. Any dispute arising from it will be brought in the courts located in Cumberland County, Maine, and you consent to that venue.
