Cookie Notice

Acadia Marketing LLC

1. Introduction and Scope

This Cookie Notice explains how Acadia Marketing LLC, a Maine limited liability company ("Acadia Marketing LLC", "we", "us"), uses cookies and similar technologies on acadiamarketingmaine.com and on any page, subdomain or transfer page that we operate or issue to clients (collectively, the "Sites"). It should be read together with our Privacy Policy and our Terms of Use, which are incorporated by reference. Hosting of client websites continues under the existing agreements, and nothing in this notice changes those agreements.

By continuing to use the Sites after being shown this notice, you acknowledge the practices described here, subject to the choices described in Section 5.

2. What Cookies and Similar Technologies Are

A cookie is a small text file that a website places on your device when you visit it. Cookies allow a site to recognize your browser, remember information between page requests and operate securely. Cookies may be "session" cookies, which expire when you close your browser, or "persistent" cookies, which remain on your device for a set period or until you delete them. They may be set by us ("first-party cookies") or by a service provider acting on our behalf ("third-party cookies").

Similar technologies include local storage and session storage in your browser, pixels or tags, and server log entries. Unless the context indicates otherwise, we refer to all of these together as "cookies" in this notice.

3. Categories of Cookies the Sites Use

The Sites use the categories of cookies described below. Not every category is active on every page.

  • Strictly necessary cookies. These are required for the Sites to function and for protected pages to operate securely. They include session cookies that record that a correct access code has been entered on a transfer page, so that the designated recipient is not asked for the access code again on each page request. They may also support load balancing, request integrity and basic security controls. These cookies do not require consent under most laws because the requested service cannot be delivered without them.
  • Preference and functionality cookies. Where enabled, these remember choices you make, such as form entries or display settings, so that the Sites behave consistently during your visit.
  • Analytics and performance cookies. Where enabled, these help us understand how the Sites are reached and used, for example which pages are viewed, how visitors arrive and how the Sites perform on different devices. The information is used to maintain, secure and improve the Sites and our services. Analytics cookies are not used on protected transfer pages to build marketing profiles.

We do not use the Sites to sell personal information collected through cookies. Where a category above is not enabled on a given page, the corresponding cookies are not set on that page.

4. Security Logging on Transfer Pages

Transfer pages are issued to a named designated recipient, are protected by an access code, and may contain domain transfer codes (also known as EPP codes) and website source files. Separately from cookies, visits and downloads from these pages are logged with the date, time, IP address and browser information for security purposes. These log entries are server-side records. They cannot be disabled through browser settings, because they are an essential part of protecting confidential materials. Further detail on how we handle log information is set out in our Privacy Policy.

5. How to Control Cookies

Most browsers accept cookies by default, but you can change your settings to block or delete them. Typical options include:

  • viewing the cookies stored on your device and deleting some or all of them;
  • blocking all cookies, or blocking only third-party cookies;
  • receiving a prompt before a cookie is stored;
  • clearing cookies automatically when you close the browser;
  • using private or incognito browsing, which generally discards cookies at the end of the session.

The steps differ by browser and device, so please consult the help section of the browser you use. Where we provide an on-page control for analytics cookies, you may use it to accept or decline them. Many browsers also support signals such as Global Privacy Control, and where we are able to detect a valid signal we treat it as a request to decline non-essential cookies.

6. Consequences of Disabling Cookies

You may disable cookies, but doing so may affect how the Sites work. If strictly necessary cookies are blocked, protected pages, including access-code transfer pages, may not recognize that a valid access code has been entered, and the designated recipient may be asked to re-enter it repeatedly or be unable to view the page at all. Forms may fail to submit, and security features may not operate as intended. Disabling analytics or preference cookies will not prevent you from using the Sites, but it may limit our ability to detect and correct technical problems and may reset saved settings between visits.

7. Third-Party Services

Some features of the Sites may rely on service providers, such as analytics, hosting or security providers, that set or read cookies under their own terms and privacy practices. We select providers with care and require them to use information only to provide services to us. We do not control the cookies of third-party websites to which the Sites may link, and this notice does not apply to them. We encourage you to review the cookie and privacy statements of any third-party site you visit.

8. Retention

Session cookies are deleted when your browser session ends. Persistent cookies remain for the period set when they are created or until you delete them, whichever occurs first. Server log entries relating to transfer pages are retained for as long as reasonably necessary for security, record-keeping and the resolution of any dispute, and are then deleted or anonymized under our internal practices.

9. Children

The Sites are intended for business use and are not directed to children. We do not knowingly use cookies to collect personal information from children.

10. Changes to This Notice

We may revise this Cookie Notice from time to time to reflect changes in the Sites, our practices or applicable law. The revised notice will be posted on the Sites and will apply from the time it is posted. Your continued use of the Sites after a revision constitutes acknowledgment of the revised notice, subject to any choices you have made under Section 5.

11. Governing Law

This Cookie Notice is governed by the laws of the State of Maine, without regard to conflict-of-laws principles. Any dispute arising from it shall be brought exclusively in the state or federal courts located in Cumberland County, Maine, and you consent to the jurisdiction of those courts.
