Client Content and Publication Policy
Acadia Marketing LLC
1. Purpose and Scope
This Client Content and Publication Policy explains how Acadia Marketing LLC, a Maine limited liability company, handles text, images, video, data, claims and other material that clients supply for publication on the Sites or on any website, page or advertisement we build or manage for them.
2. Content Supplied by Clients
Content means anything a client gives us, or asks us to use, in connection with the services, including business descriptions, photographs, logos, testimonials, reviews, license details and advertising copy. Content remains the property of the client or its licensors, subject to the Intellectual Property and Copyright document. The client grants us a limited permission to copy, adapt, format, host and publish that content as needed to perform the services under the applicable agreement.
3. Rights and Warranties
By supplying content, the client represents and warrants that:
- the client owns the content or holds all rights, licenses and consents needed to allow us to use and publish it;
- the content does not infringe or misappropriate any copyright, trademark, privacy right, publicity right or other right of any person;
- any person who appears in or is identified by the content has given the consent required by law;
- the content is lawful, and its publication will not violate any statute, regulation, professional rule or contract; and
- the client has authority to bind the business on whose behalf the content is supplied.
4. Content We May Refuse
We may decline, delay, edit or remove any content, in whole or in part, in our sole discretion and without liability, if we believe the content:
- is unlawful, deceptive, defamatory, harassing, discriminatory or obscene;
- infringes the rights of another person or may expose us or others to legal claims;
- violates the Acceptable Use Policy or the policies of a hosting provider, registrar, advertising platform or messaging carrier;
- contains malicious code or could harm the security of the Sites; or
- makes claims that we cannot reasonably verify or that appear inaccurate or misleading.
Where practicable, we will tell the client why content was declined. We are not required to publish any content.
5. Review Before Publication
We may review content before it is published, and we may format, shorten, reorganize or adjust it for layout, search visibility, accessibility or technical fit. Unless the applicable agreement states otherwise, clients are given the opportunity to review and approve material before it goes live. Approval, or a failure to object within the agreed schedule, confirms that the client has reviewed the material and accepts responsibility for it. Our review does not verify the content and does not transfer the client's responsibility to us.
6. Accuracy of Business Facts
The client is solely responsible for the accuracy, completeness and currency of every business fact it provides or approves. This includes, without limitation:
- licenses, registrations, insurance, bonding, certifications and credentials, and whether they are valid and in good standing;
- business names, addresses, service areas, hours and contact details;
- customer reviews, ratings and testimonials, which must be genuine, attributable to real customers and used with any required permission;
- awards, affiliations, guarantees and any comparative or performance claims; and
- before-and-after photographs and project descriptions, which must depict real work performed by the client.
We do not independently audit these facts, and we do not promise any marketing, ranking, traffic, lead or revenue outcome. The client must notify us promptly when any fact changes or ceases to be true, and must not ask us to publish a claim it cannot support.
7. Stock and Licensed Assets
Where we supply stock photographs, graphics, fonts, icons, templates, software or other third-party assets, they are licensed to us or to the client under the terms of their respective licensors. Those assets may be used only on the properties for which we supplied them and may not be resold, extracted or redistributed. Where a client asks us to use an asset it has licensed itself, the client must provide the license terms on request and is responsible for keeping them in force.
8. Takedown and Removal
We may remove, disable or restrict access to content, without prior notice where circumstances require, if we receive a credible complaint, a legal demand or a notice from a provider or platform, or if we reasonably believe content breaches this policy or the law. A client may ask us to correct or remove its own content by written notice to the email address below, and we will act within the agreed schedule, subject to technical limits. Removal from the Sites does not remove copies held by search engines, caches, archives or third parties, which we do not control.
9. Client Responsibility
The client is responsible for all claims, losses and expenses arising from content it supplies or approves, to the extent permitted by law and as set out in the applicable agreement. Nothing in this policy limits the Disclaimers and Limitation of Liability document. After a website or domain transfer, hosting continues under the existing agreements, and this policy continues to apply to content we host or manage until those agreements end.
10. Related Documents and Contact
This policy should be read with the Terms of Use, Acceptable Use Policy, Website and Domain Transfer Terms, and Governing Law and Dispute Resolution. This policy is governed by the laws of the State of Maine, and venue lies in Cumberland County, Maine.
