Access Logging and Security Notice
Acadia Marketing LLC
1. Purpose and Scope
This Access Logging and Security Notice explains how Acadia Marketing LLC, a Maine limited liability company ("Acadia Marketing LLC", "we", "us"), records activity on acadiamarketingmaine.com and on any page, subdomain or transfer page that Acadia Marketing LLC operates or issues to clients (collectively, the "Sites"). It applies to every person who visits, or attempts to visit, a Site, including a designated recipient of a transfer page.
By using a Site, you acknowledge that the activity described in this notice is recorded. If you do not agree, do not use the Sites.
2. Transfer Pages
We provide website design and development, website hosting, domain name management, email setup, search and advertising management, and client website and domain transfer services. As part of those services, we may issue a transfer page to a named designated recipient. A transfer page is protected by an access code and may contain domain transfer codes (also called EPP codes) and website source files. Because these materials are confidential and can affect control of a domain or website, we apply stricter logging to transfer pages than to our general pages.
3. What We Log
When you visit or interact with a Site, we may record the following information:
- Visits, including each page or file requested and the order in which requests are made.
- Access-code attempts, including successful and unsuccessful entries, the number of attempts, and the page for which the access code was entered.
- Downloads, including the name of each file or transfer code retrieved and whether the download completed.
- The date and time of each event.
- The Internet Protocol (IP) address from which the request originated.
- Approximate geographic location derived from the IP address, generally at the level of city, region or country.
- Browser and device information, including browser type and version, operating system and similar technical details sent with each request.
- Referring page and technical response data, such as status codes, that are generated in the ordinary operation of a web server.
We do not store the access code itself in readable form in the access log. We do not use the access log to record the content of any file you download beyond identifying which file was retrieved.
4. Why We Log
We keep access logs for the following purposes:
- To protect transfer codes, source files and other confidential materials from unauthorized access.
- To detect repeated or automated access-code attempts and other suspicious activity.
- To confirm that a transfer page was opened and that materials were retrieved by or on behalf of the designated recipient.
- To investigate security incidents, technical faults and reports of misuse.
- To maintain, troubleshoot and secure the Sites and the hosting environment.
- To comply with applicable law, respond to lawful requests and establish, exercise or defend legal claims.
5. Retention
We keep access logs for as long as reasonably necessary to accomplish the purposes described in this notice, including for the duration of any related services agreement and for as long afterward as is needed for security, record-keeping, dispute resolution or legal compliance. When a log entry is no longer reasonably needed, we delete it or remove information that identifies an individual. We may keep logs longer where we are investigating an incident or where the law requires it.
6. Who Can See the Logs
Access to log data is limited to personnel of Acadia Marketing LLC and service providers who need it to operate, secure or support the Sites and who are bound to treat it as confidential. Log data may also be shared with the client for whom the applicable transfer page was issued, to the extent it concerns that client's own domain or website materials. We may disclose log data to a hosting or infrastructure provider, to a registrar involved in a transfer, to professional advisers, to insurers, or to law enforcement and other authorities where we believe disclosure is required or permitted by law. We do not sell access log data.
7. Monitoring Statement
The Sites are monitored. Activity on the Sites, including access-code attempts and downloads, is recorded and may be reviewed at any time, with or without further notice to you. You should have no expectation that your activity on a transfer page is anonymous. Automated tools may be used to analyze logs, to flag unusual patterns and to temporarily or permanently block an IP address, browser or access code that appears to present a risk.
8. Unauthorized Access Prohibited
Transfer pages, access codes, transfer codes and website source files are confidential and are intended solely for the designated recipient and parties that the designated recipient authorizes. You must not:
- Attempt to access any part of a Site, any transfer page, or any file without authorization.
- Guess, share, sell, publish or otherwise misuse an access code or transfer code.
- Use automated means, including scripts, scrapers or bots, to submit access codes or to retrieve content.
- Circumvent, disable or interfere with any security, logging or access control feature.
- Download, copy, retain or use materials from a transfer page if you are not the designated recipient or an authorized party.
Unauthorized access to or use of the Sites may violate federal and state computer crime laws and our rights. We may preserve and disclose log data, suspend access, pursue legal remedies and report suspected violations to the appropriate authorities.
9. Security of Codes and Files
A transfer code moves a domain to another registrar, and after a transfer the domain and its renewals belong to the new registrant. For that reason, you are responsible for keeping any access code and transfer code you receive confidential and for using them only as intended. Hosting of client Sites continues under the existing agreements until any cutover is complete. If you receive a transfer page or transfer code that you did not expect, or you are not the designated recipient, do not use the codes and do not download any files. Notify us at the email address in Section 13.
10. Your Choices and Requests
Because access logging is necessary to protect confidential materials, it cannot be turned off for a transfer page. You may ask us what log information relates to your own access, or ask us to correct or delete it, by contacting us. We will respond to requests as applicable law requires, and we may decline a request where we need to keep the information for security, legal or record-keeping reasons.
11. Changes to This Notice
We may update this notice from time to time. The version posted on the Sites at the time of your visit applies to that visit. Your continued use of a Site after an update means you accept the updated notice.
12. Governing Law
This notice is governed by the laws of the State of Maine, without regard to its conflict of laws rules. Any dispute arising from it or from your use of the Sites will be brought exclusively in the state or federal courts located in Cumberland County, Maine, and you consent to the jurisdiction of those courts.
13. Contact
Questions, notices and reports of suspected unauthorized access should be sent to Acadia Marketing LLC, 218 Pond Road, Wilton, ME 04294, by email to info@acadiamarketingmaine.com, or by telephone at (207) 716-9079. All notices under this document should be sent to the email address above.
