Access Code and Authentication Policy

Acadia Marketing LLC

1. Purpose and Scope

This Access Code and Authentication Policy (this "Policy") describes how Acadia Marketing LLC, a Maine limited liability company ("Acadia Marketing LLC," "we," "us"), uses access codes and related authentication measures to protect confidential pages and materials. It applies to acadiamarketingmaine.com and to any page, subdomain or transfer page that Acadia Marketing LLC operates or issues to clients (collectively, the "Sites").

Our services include website design and development, website hosting, domain name management, email setup, search and advertising management, and client website and domain transfer services. Some of these services involve materials that must be released only to the person for whom they are intended. Access codes are one of the controls we use to do that.

2. Purpose of Access Codes

A transfer page may contain domain transfer (EPP) codes, website source files and related account information. An access code is a credential that identifies a person as the designated recipient of a particular page and allows that person to open it. Access codes exist to:

  • limit a transfer page to the designated recipient and parties that recipient authorizes;
  • reduce the risk that transfer codes or source files reach an unintended person; and
  • support a record of who accessed protected materials and when.

3. How Access Codes Are Issued

We issue a transfer page to a named designated recipient. The access code for that page is delivered separately from the page address, using the contact details we hold for the designated recipient. We may require reasonable confirmation of identity or authority before issuing or releasing an access code.

An access code is valid only for the page and designated recipient for which it was issued. It does not grant access to any other page, account, hosting environment or service.

4. Sessions

Access is provided through sessions. Each session begins when a correct access code is entered and ends when the session is closed, when it times out, or when we end it. A session is not a standing right of access. After a session ends, a new session requires the access code to be entered again, and we may require a newly issued access code.

We may limit the number of sessions, the length of any session, and the number of times a protected item may be downloaded. Sessions cannot be assumed to remain active across devices, browsers or networks.

5. Lockout After Repeated Failures

To protect against guessing, we limit failed attempts. After repeated incorrect entries, the page will lock and refuse further attempts for a period we determine. We may extend a lockout, require a new access code, or disable a page entirely if activity appears automated or suspicious.

A lockout is not an error and is not a reason to attempt other credentials. If you are locked out, contact us at the email address in Section 11 and we will advise on reissue.

6. No Sharing

Access codes, transfer codes and files obtained through a transfer page are confidential. The designated recipient must not disclose an access code to anyone except parties the designated recipient has authorized to act in connection with the transfer, and is responsible for the conduct of those parties. Access codes must not be posted publicly, included in unsecured messages sent to unrelated parties, stored where others can retrieve them, or entered on any site other than the page for which they were issued.

A transfer code moves a domain to another registrar. After a transfer is completed, the domain and its renewals belong to the new registrant. Anyone holding a transfer code can start a transfer, which is why these codes must be protected.

7. Logging and Monitoring

Visits and downloads from transfer pages are logged for security. Each log entry may include the date, time, IP address and browser. We use these records to detect misuse, investigate reports, and confirm access to protected materials. By using a transfer page you acknowledge that this logging takes place. Our collection and use of information is further described in our Privacy Policy.

8. Reporting Unexpected Notices

If you receive a notice, message or access code that you did not expect, or if you are not the designated recipient, do not use the access code or open any linked materials. Email us at info@acadiamarketingmaine.com so that we can review the matter. Please include the notice you received and the address it was sent to, but do not include the access code or any transfer code in your message.

If you believe an access code or transfer code has been seen by someone who should not have it, or that a page has been accessed without your authorization, tell us as soon as you become aware, using the same address.

9. Revocation and Reissue

We may revoke an access code if we believe it has been exposed, misused or issued in error, or if we are asked to do so by the designated recipient. A designated recipient may also ask us to revoke or reissue an access code by written request sent to info@acadiamarketingmaine.com. We may verify the request before acting on it.

When an access code is revoked, the associated page is closed to that code. A replacement access code, and where appropriate a replacement page address, may be issued to the designated recipient after verification. Revocation does not affect any domain transfer that has already been completed.

10. Hosting and Existing Agreements

The use of an access code or transfer page does not change the terms under which we provide services. Hosting of client sites continues under the existing agreements until the transfer is complete. Nothing in this Policy creates a transfer obligation or a right to materials that is not already provided by an applicable agreement.

11. Notices and Contact

All notices relating to this Policy should be sent by email to info@acadiamarketingmaine.com. You may also reach us by mail at Acadia Marketing LLC, 218 Pond Road, Wilton, ME 04294, or by telephone at (207) 716-9079. Written requests under Section 9 should be sent by email or mail.

12. Changes to This Policy

We may revise this Policy by posting the revised version on the Sites. Continued use of a protected page after a revision is posted constitutes acceptance of the revised Policy.

13. Governing Law and Venue

This Policy is governed by the laws of the State of Maine, without regard to its conflict of law rules. Any dispute arising from it will be brought in the courts located in Cumberland County, Maine, and you consent to that venue.

14. Disclaimer

ACCESS CODES AND RELATED CONTROLS ARE PROVIDED AS SECURITY MEASURES ONLY. TO THE FULLEST EXTENT PERMITTED BY LAW, ACADIA MARKETING LLC DOES NOT GUARANTEE THAT THEY WILL PREVENT ALL UNAUTHORIZED ACCESS.
