Acceptable Use Policy
Acadia Marketing LLC
1. Purpose and Scope
This Acceptable Use Policy ("Policy") sets out the rules for using acadiamarketingmaine.com and any page, subdomain or transfer page that Acadia Marketing LLC, a Maine limited liability company, operates or issues to clients (collectively, the "Sites"), and for sending email through systems that we operate or manage. By accessing or using the Sites or our mail systems, you agree to follow this Policy.
This Policy supplements, and does not replace, the terms of any agreement between you and us. If this Policy conflicts with a signed agreement on a specific point, the signed agreement controls on that point.
2. General Rules
You may use the Sites only for lawful purposes and only in the manner for which they are intended. You may not use the Sites or our systems in a way that harms us, our clients, our service providers or any other person, or that interferes with the security, availability or integrity of any system.
3. Prohibited Activities on the Sites
You may not, and may not permit or assist anyone else to:
- violate any applicable law or regulation, or infringe the intellectual property, privacy or other rights of any person;
- upload, transmit or distribute malware, viruses, or any code designed to disrupt, damage or gain unauthorized access to a system;
- submit false, misleading or fraudulent information through any form, including contact, booking and request forms;
- overload, flood or otherwise burden the Sites or the infrastructure that supports them, including through automated or repeated requests;
- use the Sites to harass, threaten or defraud any person, or to distribute unlawful, defamatory or obscene material;
- copy, frame, mirror or republish the Sites or their content except as permitted in writing or by applicable law; or
- remove or alter any copyright, trademark or other proprietary notice.
4. Scraping and Automated Access
You may not use robots, spiders, crawlers, scrapers or other automated means to access, collect, index or extract content or data from the Sites, except for ordinary search engine indexing that respects our published crawling directives. You may not harvest email addresses, telephone numbers or other contact information from the Sites for any purpose, including unsolicited marketing.
5. Probing, Testing and Security Violations
You may not probe, scan or test the vulnerability of the Sites or any related system or network, or breach or attempt to breach any security or authentication measure, without our prior written authorization. You may not attempt to access data or accounts that are not intended for you, or monitor data or traffic on any system without permission.
6. Circumventing Access Controls
Certain parts of the Sites, including transfer pages, are issued to a named designated recipient and protected by an access code. Those pages may contain domain transfer codes (also known as EPP codes) and website source files. You may not:
- access, or attempt to access, a protected page if you are not the designated recipient or a party the designated recipient has authorized;
- guess, test, share, sell or publish access codes, transfer codes or the contents of protected pages;
- bypass, disable or interfere with any access code, authentication step, rate limit, logging function or other control; or
- use a transfer code or downloaded file for any purpose other than the one for which it was issued.
If you receive a protected page, access code, transfer code or file in error, you must not use it, and you should notify us at info@acadiamarketingmaine.com.
7. Email and Messaging
You may not send email or other messages through our systems, or through mailboxes we set up or manage, in a manner that violates applicable law, including laws governing commercial email. Without limitation, you may not:
- send unsolicited bulk or commercial messages ("spam"), or messages to recipients who have not consented where consent is required;
- use false, forged or misleading headers, sender names, subject lines or routing information;
- send phishing messages, or messages intended to deceive recipients into disclosing credentials, payment details or other sensitive information;
- distribute malware or links to malicious content by email;
- fail to honor an opt-out request, or omit information required by law from commercial messages; or
- use mailboxes to harvest addresses, conduct dictionary attacks or relay messages for third parties.
8. Impersonation
You may not impersonate any person or entity, or falsely state or imply an affiliation with us or with any other person or organization. This includes creating look-alike pages, sending messages that appear to come from us, or misusing our name, logos or branding. You may not misrepresent your identity or authority when requesting domain, hosting, email or transfer services.
9. Domains and Hosting
Domain names, websites and mailboxes that we register, host or manage may not be used for any activity prohibited by this Policy. Hosting of client sites continues under the existing agreements, and this Policy applies to that hosting in addition to those agreements. Where a transfer code is issued, the designated recipient is responsible for its safekeeping and for the use of the domain after transfer.
10. Monitoring and Logging
We log visits to and downloads from transfer pages, including the date, time, IP address and browser, for security purposes. We may also monitor and review use of the Sites and our systems to the extent permitted by law to protect their security, to investigate suspected violations of this Policy and to comply with legal obligations. We are not obligated to monitor the Sites or our systems.
11. Enforcement
We may investigate suspected violations of this Policy and may take any action we consider appropriate, with or without notice, including:
- removing or disabling content, pages, forms or mailboxes;
- blocking IP addresses, rate-limiting or restricting access to the Sites or any part of them;
- revoking or reissuing access codes and withdrawing transfer pages;
- suspending or terminating services, subject to the terms of any applicable agreement;
- preserving and disclosing information to law enforcement, regulators or affected parties where permitted or required by law; and
- pursuing any legal or equitable remedy available to us.
Our election not to act on a particular violation does not waive our right to act on that or any other violation. You are responsible for all activity conducted using your access codes, accounts and mailboxes.
12. Reporting Violations
If you believe the Sites or our systems are being used in violation of this Policy, or if you suspect unauthorized use of an access code or transfer code, please contact us at info@acadiamarketingmaine.com or (207) 716-9079, or write to Acadia Marketing LLC, 218 Pond Road, Wilton, ME 04294. Please include enough detail for us to review the matter.
13. Governing Law and Venue
This Policy is governed by the laws of the State of Maine, without regard to its conflict of laws principles. Any dispute arising out of or relating to this Policy shall be brought in the state or federal courts located in Cumberland County, Maine, and you consent to the jurisdiction of those courts.
14. Changes to This Policy
We may update this Policy from time to time by posting the revised version on the Sites. Your continued use of the Sites or our systems after a revision is posted constitutes acceptance of the revised Policy.
